One of the key changes is the introduction of criminal liability for drivers caught again driving while intoxicated within one year of an administrative penalty.
If a person is again found driving under the influence within a year, they may face a fine of up to 150,000 soms or up to one year in prison.
Penalties are even stricter for traffic accidents involving injuries caused while under the influence of alcohol or drugs. If the crash results in serious bodily harm, the offender may face five to eight years in prison. If the consequences are especially severe, the sentence increases to eight — ten years. In all cases, the court will also revoke the driver’s license for up to 12 years.
The law also changes vehicle towing rules.
Cars can now be forcibly taken to impound lots only in clearly defined cases, such as when a vehicle is left on railway tracks, bridges, pedestrian crossings, blocks emergency service access, occupies disabled parking spaces, or obstructs emergency works.
For the first time, the legislation introduces a wheel-locking mechanism.
In addition to cars, such devices may also be used on motorcycles, quad bikes, and other motor vehicles by immobilizing steering systems or pedals.
Fines for driving without documents have also been revised.
Driving without a license, registration documents, or the required category will result in a fine of 1,000 soms (10 calculated rates). Driving without the right to operate a vehicle will be fined 15,000 soms, while repeat offenders who were previously deprived of their license will face a 20,000 soms fine.
